Commercial One Team Agreement The Team is accepting membership applications from Licensed Solid Source Realty Agents, and accepting membership into The Team on a contractual basis. The signing of this agreement constitutes acceptance of the Agent into The Team as a Team Member, and the acceptance by The Team of the herein listed agent/member. Membership in The Team does NOT represent an employment relationship. Each member of the team has a relationship that falls under the definition of a 1099 employees for tax purposes, and this agreement is for the purpose of identifying the guidelines and responsibilities of both The Team and its members in this relationship. The details of those obligations are outlined below. The Team does hereby agree: 1. To provide an ongoing training environment for each member of the team. This training will be conducted in classroom, and on an as needed ongoing individual basis. The team encourages each member to become niche specific in their chosen disciplines within the commercial real estate industry, and the team will ALWAYS provides an atmosphere where every associate can network and share their knowledge openly to serve the highest and greatest good of the others on the team. 2. To provide clerical, office, and research assistance for you whenever possible, and provide all members with support services as they are needed and available. The team will list and maintain all listings and assist you with your pre and post-closing needs. Respond to your office phone calls, and those responding to your advertising , and monitor online activities and communications with your clients as needed and/or in your absence. The Team is here to support your success ! 3. To provide an office environment, where you and your clients can meet, and where you become part of the team, supporting and assisting other members with your niche specific experience, as well as sharing in their skills and experience. You will be asked to not only attend, but to conduct training for new members of the team, and assist by sharing information and experiences you have gained with your specialty as needed. 4. To provide team leads and prospects as “fairly and proportionately” as possible to EVERY member of the team. Leads that are generates by our fellow Solid Source Residential Agents, are the property of The Commercial One Team, and YOU have the option of determining the amount of commission split or finders fee that you will pay. The splits or fees you pay for those leads will be done AFTER you have paid your 20% to the team. Example: A sale closes with a $10k commission. You received the lead from the team, and agree to pay the agent a finders fee of 20%. From that $10K commission at closing, you will pay your team $2k leaving you with $8K. You will then pay the referring agent their 20% of that $8k or $1600.00, leaving you with $6,400.00K If you MENTOR with that SSR agent on a “50–50 split”, the disbursement at closing funds would be $2K to the team, and $8K split between yourself and that agent. REMEMBER, these are leads on sales you otherwise wouldn’t have… on your own deals, you are not splitting commissions or paying finders fees with outside agents, and you do not have to work a lead provided to you… this is completely at you’re your option.
1. To split all commercial sales 80% to the Member and 20% to The Commercial One Team. This does NOT include any residential properties. A Commercial Sale is identified as any sale that does not involve traditional and /or conventional residential financing. You are FREE to handle commercial Transactions on your own without involving any relationship with The Commercial One Team, PROVIDED that you inform the team IN WRITING upon entering into the transaction, and use none of the resources of the team or support or assistance from any of the teams members. These NON-TEAM TRANSACTIONS shall be handled under the Solid Source Realty brand ONLY, and you WILL be required to pay your Commercial Transaction Fee (5%) to Solid Source. If the team IS assisting you with this transaction and earning the 20% split, the team will pay any fees (5%) due to Solid Source. 2. All active members of The Commercial One Team will turn all of their transaction into the team support office for legal review at listing on contract and at closing, even if the team is not splitting or assisting you with the sale. If the team is NOT involved in the transaction, you will request a “team waiver” in writing from a Director of the team. Solid Source Realty will monitor ALL Commercial One Team Members transactions to assure compliance with this. 3. To share the knowledge and experience of your specialty with other members of the team, and when timely or hand-on support is involved, you agree to pay your way by sharing your income (fairly) with those members of the team who openly supported your efforts to get there. There are no “rules” with this, and when there are large sums of money involved, any “shared” compensation should be discussed first and contractually agreed. Everyone here NEEDS to make a living, and when fairness can’t guide the situation, formal agreement should be established. The Commercial One Team is a select group of individuals who have realized by experience, that we can become more effective through sharing our knowledge, skills, and resources with others. 4. Each member of the team will pay a total of $400.00 at some point during their 1st 6 months, to offset the expenses involved in training and support. This shall be considered a contribution to support the teams efforts in developing support services for everyone. We will not do a formal accounting of these funds… We want every member to want to pay their own way, and we trust that each member will individually be responsible, and respect the time and financial efforts required to create YOUR Commercial One Team. With the signatures below, the Team Member and the team Directors agrees and understand the terms and responsibilities set forth in this agreement.
